1. General

1.1. Nothing in these terms and conditions is intended to affect your statutory rights.

1.2. The trademarks and logos displayed on the website are the property of the company. You are not permitted to use these without written consent of the company and you accept that any such use may constitute an infringement of the relevant proprietor’s rights.

1.3. These terms and conditions and any contract concluded incorporating these terms and conditions shall be governed by English law and all disputes shall be submitted to the exclusive jurisdiction of the English courts.

1.4. The website may contain hyperlinks to third party websites. The operation of those websites is out of the company’s control and you may use them at your own risk. The company accepts no liability for any damage arising out of any use of those websites.

1.5. The company collects and stores your personal details without disclosing it to any 3rd party and is dedicated to ensure that the privacy of your personal information is protected in accordance with the Data Protection Act 1998 and in accordance with GDPR.

1.6. The company may contact you from time to time with offers and promotions via email or phone.

1.7. The company is entitled to charge the guests for any damages which are intentional and/or caused by misuse of items. The Lead Name will be responsible for their group and takes full responsibility of said damages and will be charged accordingly.

1.8. While you are on our premises, you must ensure to conform to our codes and regulations, adopt proper standards of behaviour, and cooperate with our employees.

1.9. The company will not tolerate any kind of bullying, harassment or aggressive behaviour towards its employees. Any such behaviour may result in refusal of entry, session termination or removal from our site. Under such a scenario, no compensation, refund (in full or part) or re-booking of the session will be made by art-ful splat.

2. Bookings of Activities at art-ful splat

If you are booking on behalf of a group, please ensure that you have the consent of all members of the party before making a booking and that all members of your party have read and agree to be bound by these terms and conditions. The person who signs the booking form or completes the booking online will be the “lead name” for the purposes of the booking. The lead name must be 16 years of age or over at the time of booking. The lead name is responsible for payment of the total booking price, which may include any subsequent cancellation or amendment charges that may be payable. The lead name must confirm that all the other members of the party agree to be bound by these terms and conditions and provide accurate and full information to the remainder of the group in relation to the booking, including any subsequent changes.

2.1. Only person(s) who are at least 16 years of age are permitted to book an activity.

2.2. Any person(s) who are under the age of 16 taking part in the activity must be accompanied by an adult:

• a) For children aged 4 to 7 years, we encourage people to purchase the Adult & Young Child ticket. All children aged 4–7 years old must be accompanied by an adult on an Adult & Young Child booking. Adults are not able to supervise more than one young child. A maximum of one adult and one child are permitted per station.
• b) All children aged 8–15 years old must have a responsible adult in the studio to supervise them. Adults must pay for their own station.
• c) Unfortunately, due to the nature of our venue, non-paying spectators cannot be admitted.
• d) If you arrive and have not booked the appropriate paying adult supervision for the activity/age range, you risk losing your booking and no refund shall be made. It is your responsibility to ensure that you have booked correctly.

2.3. In the event of any person(s) under the age of 16 taking part in an art-ful splat activity, the Lead Name on the booking confirms that they shall accept responsibility for the welfare and behaviour of all those members of their group who are aged under 16.

2.4. This is a live event, and once the booking is confirmed, we cannot accept any cancellations or give any refunds. However, the company may reschedule the event once, in accordance with the following terms:

• a) If cancellations are more than 48 hours in advance of your booking we will reschedule your session free of charge.
• b) If cancellations are made less than 48 hours in advance of your booking you will not receive a refund. All bookings are final.
• c) If you are rescheduling between 48–24 hours in advance, you will incur a £10 rescheduling fee per station.
• d) We are unable to reschedule bookings with notice of 24 hours or less. In this case you will not receive a refund.
• e) If your whole party or an individual guest in a party does not show up to their booking, they will not receive a refund and do not have the option to reschedule.
• f) Any rescheduling must be confirmed by email or in writing from the company and the Lead Name.

2.5. If art-ful splat should have to cancel or reschedule your booking for any reason, we will offer a 100% refund or offer an alternative date for your booking.

2.6. Any purchase on the website is only valid when processed by the company. You shall receive a confirmation once your booking is processed.

2.7. If you wish to transfer your booking(s) into someone else’s name, you must contact the company by email at least two hours prior to the start of your booking. Your request may not be honoured and can be denied.

2.8. Bookings may not be transferred or resold for commercial purposes or at a premium. If a booking is transferred or resold in breach of this condition, the bearer of the booking or the person claiming the right to attend the event will be refused admission.

2.9. You are entirely responsible for entering your details correctly on the online booking form.

2.10. You are responsible for your own time-keeping. If you do not arrive on time we reserve the right to cancel your booking. You must arrive 5–10 minutes before your session’s stated start time to allow for the session to start promptly. A booking becomes a no-show and entry will be declined if you are late by 20 minutes or more. In such a situation the full booking total for all seats is non-refundable and the booking will not be rescheduled.

2.11. You will not be permitted entry to art-ful splat earlier than 10 minutes prior to your booking slot. Our staff will be working with other visitors or preparing materials for your arrival.

3. Special Requests

Any special requests must be advised to us at the time of booking. Although we will endeavour to meet any special requests, we regret we cannot promise that any requests will be complied with unless we have specifically confirmed this in writing. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed. We do not accept bookings that are conditional upon any special request being met.

4. Access, Disabilities & Medical Issues

4.1. art-ful splat is located at 71 Rowlands Road, Worthing, BN11 3JN. If you have any questions about the accessibility of our venue, please contact us before booking so we can advise on suitability and discuss any reasonable adjustments we can make.

4.2. If you or any member of your party has any medical problem or disability which may affect your booking, you must inform us in writing before booking so we can advise as to the suitability of the chosen activity and offer potential options to facilitate access requirements to the best of our ability. Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or, if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details.

4.3. Our venue is lively and can be very busy, particularly at weekends. We do have background music playing and the environment (particularly the splat art studio) has the potential to be overstimulating for neurodivergent guests and those who struggle with sensory overload. Please contact us before booking so we can recommend the most suitable session for your needs.

4.4. For disabled people who would not be able to attend our venue without the support of a carer or personal assistant, we admit one carer or personal assistant free of charge with a full price ticket. Please note, the carer or personal assistant will not be allocated materials to create their own artwork. To book this ticket you must provide valid proof of ID upon arrival. We accept the following documents:

• Attendance Allowance Letter (AA)
• Carers’ Allowance Letter of Award
• Disability Living Allowance Letter (DLA)
• Personal Independence Payments (PIP)
• Valid Blue Badge

If no proof of identity is provided upon arrival, we reserve the right to charge the carer/support worker the cost of a full price ticket.

5. Price & Payment

5.1. The prices of our activities are stated on the website under the booking section.

5.2. The prices are set and non-negotiable.

5.3. Standard bookings and birthday parties can be made online only. Full payment is required at the time of booking.

5.4. Group and corporate bookings can be made by phone, email or online form submission. A 50% deposit will be requested by payment link with the final balance due 14 days in advance of the booking.

5.5. In case of fewer people attending the event than booked for, the price difference will not be refunded.

5.6. Increasing the number of people attending an event must be approved by art-ful splat in writing, in advance, to account for capacity issues. Any price difference can be settled upon arrival.

5.7. We reserve the right to amend the price of bookings at any time.

5.8. From time to time art-ful splat may offer promotions or special discounts. All promotions will be advertised no later than one (1) week prior to the start of the promotional period unless of special exceptions such as Flash Sales and Black Friday amongst others. Promotions are valid only for new bookings made during the specified promotional period and cannot be applied retrospectively to bookings confirmed before the offer was launched. To ensure fairness and consistency for all guests, these terms apply to all bookings without exception.

7. Safety

7.1. Each attendee will be briefed before their session by a member of our team on the process, health and safety, our rules and expectations. After being briefed, each guest will participate at their own risk. The company is not liable for any personal or equipment damages caused by not following the rules described before the session and in the FAQs on our website.

7.2. Fire exit signs are clearly marked.

7.3. Persons who in our staff’s opinion are excessively under the influence of alcohol or appear to have used drugs will not be admitted and their session will be marked as a no-show.

7.4. Only soft drinks purchased from art-ful splat may be consumed on our premises unless otherwise stated.

7.5. You may bring a reasonable and not excessive amount of alcoholic drinks to our Adults Only sessions or private hire bookings.

7.6. To be admitted you must confirm the full name of the booker and may be asked to confirm the phone number and email address the booking confirmation was sent to.

7.7. By booking with art-ful splat, you (“the Lead Name”) and all members of your group agree to be bound by these Terms and Conditions. art-ful splat and its employees shall not be liable for any death, personal injury, loss or damage caused while in the venue or on the premises.

7.8. We strongly advise guests to wear old clothing and footwear that they do not mind getting paint on.

7.9. All guests participate in the activity at their own risk. art-ful splat accepts no liability or responsibility for damage to clothing, footwear, accessories, or any other personal belongings during the experience.

7.10. Please note that while our Personal Protective Equipment (PPE) is designed to provide an additional layer of protection, it is paint-resistant rather than completely paint-proof.

8. Photos

8.1. Photos may be taken during your session for use in our social media campaigns.

8.2. Photos may be stored on our server for future use.

8.3. Photos may be uploaded to social media sites without names.

9. Website Use & Security

9.1. The website https://www.art-fulsplat.co.uk is owned and operated by art-ful splat. The company holds the right to amend or vary these terms and conditions including any of the contents of this website from time to time at its sole discretion without prior notice.

9.2. The terms and conditions apply to the use of the website by any visitor and should be read carefully before any use.

9.3. The company does its best to supply you with the most up to date and accurate information on the website.

9.4. The website is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this website without the written consent of the company.

9.5. You are not permitted to link to, or use all or any part of the website for any purpose which is fraudulent, unlawful, defamatory, harmful, obscene or objectionable.

9.6. You accept that the internet is not fully secure. The company will take all appropriate steps to protect your information.

9.7. The company shall not be liable to any person for any direct or indirect, consequential or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of any use of the website.
